Under Regulation 21 of the Financial Intelligence and Anti-Money Laundering Regulations (FIAMLR) 2018, a reporting person (LS Advisors Ltd) may rely on a third-party to introduce business or to perform the CDD measures. Where reliance is placed on third-parties, LS Advisors Ltd has a legal obligation, under section 8 of the Financial Services Commission (FSC) Anti-Money Laundering and Combatting the Financing of Terrorism (AML/CFT) Handbook, to undertake testing on the third-party’s procedures and to ensure that the CDD documents can be retrieved without undue delay and that the documentation received is sufficient pursuant to section 17(2)(v) of the Financial Intelligence and Anti-Money Laundering Act (FIAMLA) 2002. This AMLCFT Questionnaire serves as testing to LS Advisors Ltd to meet and fulfil its above legal obligations. This AMLCFT Questionnaire should be duly completed and signed by your Compliance Officer(CO) / Money Laundering Reporting Officer (MLRO) or any equivalent position. Please complete and answer ALL questions in sections A and B below. NO Questions should be left unanswered. Further information should be provided where applicable. As part of our compliance testing, please provide KYC documents and documentary evidence on the source of funds and wealth including EDD documents (where applicable) on a sample of 6 clients as per section C below. All information and documents provided in this AMLCFT Questionnaire will be strictly kept confidential. LS Advisors Ltd has a legal duty to record and maintain data in accordance with Data Protection Act and relevant Data Protection Regulations.
